These Terms of Service ("Terms") govern your use of the WildComply application and website (the "Service") operated by WildComply ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Account Registration
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account.
You agree to notify us immediately at mike@wildcomply.app if you become aware of any unauthorized use of your account.
2. Description of Service
WildComply provides a digital platform for Texas property owners with approved TPWD wildlife management plans to track their required wildlife management activities and prepare the 1-D-1 Open Space Agricultural Valuation Annual Report (PWD-888 form) for submission to their local appraisal district. The Service includes mobile applications (iOS and Android), a web application, and related features such as GPS-tagged photo capture, compliance scoring, and report preparation.
Important: WildComply is a compliance documentation tool. It is not a substitute for legal, tax, or professional wildlife management advice. We do not guarantee that use of the Service will result in approval of your wildlife management tax valuation by any county appraisal district. You are solely responsible for ensuring your wildlife management activities and filings meet all applicable county, state, and TPWD requirements.
3. Subscription and Billing
Plans and Pricing
The Service is offered on a monthly subscription basis. Current plan options and pricing are displayed on our website and within the application. Prices are in U.S. dollars and are subject to change with 30 days' notice.
Free Trial
New accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial, you must subscribe to continue using the Service. If you do not subscribe, your account enters read-only mode.
Billing
Subscriptions are billed monthly on the anniversary of your subscription start date. Payment is processed through Stripe, Inc. You authorize us to charge your payment method on file for recurring subscription fees.
Cancellation
You may cancel your subscription at any time through Settings > Subscription. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months. After cancellation, your account enters read-only mode and your data is retained for 12 months.
4. Acceptable Use
You agree to use the Service only for its intended purpose: tracking and documenting wildlife management activities for tax compliance purposes. You agree not to:
- Use the Service to create false, misleading, or fraudulent compliance records
- Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
- Attempt to gain unauthorized access to the Service, other user accounts, or our infrastructure
- Use the Service to violate any applicable law or regulation
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use automated tools (bots, scrapers) to access the Service without our written permission
- Resell or sublicense access to the Service without authorization
5. Data Ownership
Your Data
You retain full ownership of all data you input into the Service, including activity records, descriptions, photos, property information, and generated reports. We claim no ownership rights over your content.
License to Process
By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data solely for the purpose of providing the Service to you. This license terminates when you delete your account.
Data Export
You may export all of your data at any time through the data export feature in Settings. We support export in standard formats (CSV, JSON, PDF, and ZIP for photos).
6. Intellectual Property
The Service, including its design, software, logos, and documentation, is owned by WildComply and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
"WildComply" and the WildComply logo are trademarks of WildComply. You may not use our trademarks without our prior written consent.
7. Third-Party Services
The Service integrates with third-party services including Stripe (payment processing) and cloud hosting providers. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.
8. Limitation of Liability
Tax and Compliance Disclaimer: WildComply is a documentation and organizational tool. We do not provide legal advice, tax advice, or wildlife management consulting services. The compliance scores, practice recommendations, and form templates within the Service are provided for informational and organizational purposes only. You are solely responsible for the accuracy of your wildlife management records and the timely submission of all required documents to your county appraisal district. WildComply is not liable for any tax penalties, rollback taxes, or loss of tax valuation status resulting from your use or non-use of the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WILDCOMPLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or alteration of your data
- Any interruption or cessation of the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
Our total liability for any claims arising from or relating to these Terms or the Service shall not exceed the total amount you paid to us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless WildComply, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
10. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned maintenance when possible.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. For material changes that reduce functionality, we will provide at least 30 days' notice.
11. Termination
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees after reasonable notice. Upon termination for cause, you may lose access to your data. We will make reasonable efforts to allow you to export your data before termination, except in cases of fraud or abuse.
You may terminate your account at any time by following the account deletion process in Settings. See our Privacy Policy for data retention details following account deletion.
12. Dispute Resolution
Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
Informal Resolution
Before filing any formal legal proceeding, you agree to first contact us at mike@wildcomply.app and attempt to resolve the dispute informally for at least 30 days.
Jurisdiction
Any legal proceedings arising from these Terms or the Service shall be brought exclusively in the state or federal courts located in Harris County, Texas. You consent to the personal jurisdiction of these courts.
13. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by email and by posting a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to updated Terms, you must stop using the Service and may cancel your subscription.
14. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and WildComply regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Waiver: Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.
- Assignment: You may not assign or transfer your rights under these Terms. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.
